Terms and Conditions of Business and Use

If you want to buy wine from the Bucktroutsonline web site you can only do so on the terms and conditions set out below, and by ticking the terms and condition button at the time of ordering you are agreeing to be bound by them. They are designed to be fair to you and to us, if you are in any doubt or require further information before ordering do not hesitate to telephone, Fax. or e-mail us. Any changes to the Terms and Conditions will be updated by this posting.


Customer Promise

Quality - If you buy any of our wines and you find it is corked or oxidised, we will credit your account for the full amount for that bottle. If you have bought a whole case of one particular wine, then we will refund the whole case provided of course that you have only opened one bottle from the case.



Delivery

Delivery is free on orders over £25.00 regardless of how many cases you order. We deliver ONLY in Guernsey. So if you live in the Arctic Circle and think you've discovered a great place for cheap wine, think again. And we've got our own free ice thank you very much!.

Standard deliveries are made Monday - Saturday, 9.00am - 6.00pm We are closed on Sundays. Our Flagship Store is open on Bank holiday Mondays 10.00 am until 1.00pm. Closed Good Friday, Christmas Day and New Years' day.

Orders received before 9.30am are usually delivered same day. Other orders will be delivered next working day. When ordering online please complete the "Driver Instruction" section. Here you can notify us of an estimated preferred delivery time or a safe place to deposit your order should you not be in.

If you do not complete this section and are not in, the driver will leave a card and you can organise a more convenient delivery time/day within the times stated.

Estimated and preferred times may vary. Although our drivers will do their very best to arrive around your preferred time, they are not taxi drivers. Please allow for slow moving tractors , buses, roadworks and diversions.

If you have any queries regarding delivery please do not hesitate to contact us.

The free delivery service only applies to goods delivered to one recipient at a single address.

If the order is to be delivered to an address other than your home e.g. a gift or when you are not available to receive the order we reserve the right to confirm your instructions by telephone. This procedure is to protect minors from alcohol in the absence of adults.

Bucktroutsonline does not accept any responsibility for late or non-delivery of goods arising from incorrect delivery information being provided.

Breakages

If there are any breakages, the carrier will need to collect the complete case including the damaged contents. If you have any queries regarding delivery please contact us.

Availability of Wine

Wine is an agricultural product and runs out from time to time. If you order a wine which is out of stock, we may change the bottles, but we never use this as an opportunity to advertise a good wine and supply plonk. We promise that we will only ever replace with an appropriate option. If you ever have cause to disagree with our choice of replacements, we will give you a credit for any of the bottles that we have switched, no questions asked.

We may accept the whole or part of your order, both in respect of the kind of products and quantity of products ordered. The price will be reduced accordingly

Customer Satisfaction

if you are dissatisfied with our performance in any way, please contact our Store Manager at our Flagship Store, immediately on 727208. At bucktroutsonline, we aim to deal with all enquiries fairly, confidentially and quickly. We try to resolve most issues immediately, but where this is not possible, we will keep you informed about progress until a satisfactory resolution has been achieved. We are continually improving our service, but if you have any particular ideas or suggestions about how we can improve, please contact us.

Right To Terminate

This Customer Promise is here for the good of all of our customers. If we feel that it has been abused, we reserve the right to close your account, once we have met our obligations under this promise. If we do inactivate your account, and you choose to make another purchase, whether through that account or any other, then our obligation to you for any claim will be limited to your statutory rights and we will not be bound to deliver our full Customer Promise.

Prices and Payment

All prices are quoted in pounds sterling, and may be per litre, bottle or multiples thereof, as marked.

We accept payment by Switch, Visa, MasterCard, Maestro Solo, American Express and Diners Club.

Any discounts offered are based on previously advertised, non-discounted prices that were available for consumers to buy for at least 28 consecutive days in the previous 6 months from our three shops. Where a particular wine is part of a pre-mix case with a general discount applied, the discounted price for the case is relative to the previously advertised, non-discounted prices for the constituent wines (as above).

With over 700 products in our online store there is always the possibility of an error on our website. In the event of a price or typographical error clients who have purchased goods online will receive a full refund.

Age Restriction

At Bucktrouts we are rigorous in the enforcement of the law concerning the prohibition of sales of intoxicating liquor and tobacco to persons under the age of 18.

The law in Guernsey bans such a sale, and accordingly we will not deliver intoxicating liquor or tobacco to anybody who appears to be under the age of 18.

In the case of a gift, the recipient must be over the age of 18 years.

In the event of an order being placed by a person under the age of 18, we will report him/her to the authorities.

We will not deliver liquor or tobacco or release these products for collection to anyone who is or appears to be under the age of 18 without a valid form of photographic identification, and we reserve the right to reject any order relating thereto.

By placing an order and ticking the over 18 button you confirm that you are at least 18 years old.

Sorry to have to state the obvious, but once the wine has been delivered, according to your original delivery instructions, it becomes the recipient's responsibility. This does not affect your right to breakages mentioned above.

Security


If you are nervous about shopping on the web, don't be. Bucktroutsonline.com uses SECPay Ltd. to process all credit and debit card online payments. SECPay Ltd is a secure online payment service provider.

Once you have finished shopping, have reviewed and are completely satisfied with your order you will be transfered to SECPay for final card payment.

Your card details are collected by SECPay. This information is not held on our server.

Vouchers

If you have a voucher to redeem against the purchase of wine from us, the terms and conditions on that voucher apply, and you agree to be bound by those terms and conditions.

Promotional shop vouchers and discount vouchers can only be used in Bucktrouts shops up until the valid date on the voucher. They cannot be used in conjunction with any other offer.

Vouchers are non-transferable and may not be sold or auctioned.

Cancellations

You may cancel your order for any reason whatsoever at any time up to 7 working days from the day after the date you receive your wine, provided all of the bottles are unopened and intact

We shall reimburse the price of the wine within 30 days from the date you notify us of the cancellation. It is your responsibility to hold onto the wine and take reasonable care of it until we come to collect it.

Returns

If some or all of the bottles of wine in a case are broken or spoiled when they are delivered you should notify us as soon as possible. You may choose either to return the whole case or just the affected bottles for a refund.

You must notify us of all wines which are due to be returned for any of the reasons within 7 days from delivery of the wine using one of these methods:

All refunds and reimbursements will be paid within 30 days of you notifying us of your wish to return wine, provided the wine has been collected by our carrier.

Any wines collected by our carrier must be in their original box to avoid further breakages, where possible.

Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or mis-described goods. Further information about your rights is available from Citizen's Advice Bureau.

Intellectual Property Rights

You are entitled to use our web site in accordance with these Terms and Conditions only.

All persons, individual and corporate, are prohibited from providing hypertext or other links to the bucktroutsonline.com web site, other than to our home page, from their own web site or from a third party's web site, without our prior written consent.

Warranties

We warrant that the wines will be of satisfactory quality and fit for their general purpose.

Limitation of Liability

Nothing in these Terms and Conditions shall exclude Bucktrouts Co. Ltd. liability for personal injury or death caused by its negligence.

We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where:
loss or damage was not foreseeable to both parties when the contract was formed;
loss or damage was not caused by any breach on the part of the supplier;
loss or damage relates to business and/or non-consumers.

We will not be liable for loss or damage caused by the customer handling the wine. In particular we will not be liable for spillages or breakages.

Customers should also be aware of the following inherent risks and warnings:
Alcohol should be consumed in moderation.
A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.
Red wine in particular may cause staining if spilt so extra care should be taken.
Sparkling wines and champagnes can be volatile due to the build up of gasses extra care should be taken with correct storage and opening.

Data Protection

By providing your details to bucktroutsonline on our web site, you consent to Bucktrouts Co. Ltd. maintaining, recording, holding and using the information you give Bucktrouts Co. Ltd. at the time of ordering to process your orders, to improve our service to you and inform you of promotions. All data is collected lawfully and maintained in accordance with the Data Protection (Bailiwick of Guernsey) Law 2001.

Our Privacy Promise

We take your privacy very seriously and will not pass your details to any third party, other than where we have to do so to get your wine to you, e.g. deliveries. From time to time, bucktroutsonline may send information about discounts, free stuff and personalised offers on products including exclusive deals, unless you have told us not to do so by ticking the 'opt out' box on your Account Details.

If you opt-out from hearing from Bucktrouts on line, the onus to review any changes to terms and conditions becomes your responsibility.
